Terms & Conditions

BOOKING FEE

A booking fee of 50% of the final figure is required to secure the date. Dates are reserved only when the booking fee is paid. This sum will apply towards the contract fee.

TERMS

It is mutually agreed that the following terms and conditions form an integral part of this contract/invoice, and that no variation or modification of this contract shall be effective unless accepted by Sarah Minchin in writing before the event. Any requests made after this may not be accepted.

PAYMENTS

The balance of the payment for the services contracted must be paid within 1 week of the date of the shoot. Proofs will not be released until the full payment has been made.

CANCELLATION

In the event of the Client cancelling a booking for photography Sarah Minchin reserves the right to charge a cancellation fee in accordance with the following scale:

The booking fee (50% of the agreed fee) if cancelled 6 months or more before the date.

75% of the agreed total fee if cancelled less than 6 months prior to the date.

100% of the agreed total fee if cancelled within 7 days of the date.

Should the cancellation of the shoot turn out to be a postponement, then subject to availability on a new date, monies other than the booking fee may be applied to the new date.

In the event of Sarah Minchin having to cancel the shoot, due to illness, accident or act of God, any fees paid, including the deposit, will be returned to the Client.

COVID CLAUSE

If a booking needs to be rescheduled or cancelled due to COVID-19 restrictions, no charge will be made. If Sarah Minchin isn’t available for a rescheduled date, a full refund will be made.

WEATHER AND/OR DELAYS

Weather permitting, the photographs will be taken as agreed. In the event of inclement weather Sarah Minchin, in co-operation with the Client, will make the necessary changes to the schedule and will do her best to produce coverage within the time allocated to her. Similarly, when delays occur due to circumstances outside her control, Sarah Minchin will stay on beyond the agreed time but may charge a small additional fee for extra time involved.

REQUESTED PHOTOGRAPHS

Sarah Minchin will honour requests for specific photographs subject to weather and time restrictions and the availability and co-operation of the person(s) concerned.

PROVISION OF IMAGES

Sarah Minchin will supply only those images that she has selected for editing. The client understands that not every photograph taken on the day will be presented as a final image.

COLOUR MATCHING

Owing to photo chromatic anomalies caused by a combination of certain dyes and materials, especially in man-made fibres, it is sometimes impossible to record on camera the exact colour of materials as perceived by the human eye. When processing images, Sarah Minchin will endeavour to achieve a pleasing overall colour balance based on natural flesh tones. It is understood that some colours may not remain consistent throughout a set of photographs owing to variations in lighting conditions. Due to the limitations of computer monitors it is understood that images may appear differently according to the specification of each monitor and that prints will not match images rendered on any particular computer monitor.

The copyright in all photographs created by Sarah Minchin shall remain her property in accordance with the Copyright, Design and Patents Act 1988. The Client(s) retain the right to share or reproduce the images for personal use only and no profit shall be made from this. When sharing images online, the watermarked versions of the photographs must be used.

Sarah Minchin accepts no responsibility for the quality and colour reproduced from third party printers of images supplied, due to variations in paper and third-party printing processes and profiles.

ELECTRONIC IMAGES

All electronic images created by Sarah Minchin shall remain her property, she will undertake to store all such electronic images safely and make them available for future reproduction. Photographic prints will become and remain the property of the Client(s). However, the Client(s) specifically acknowledge that ownership of prints does not imply ownership of the copyright in the images on them.

DELIVERY TIMES

Up to 5 watermarked images will be available to view on the Facebook page within 24 hours of the event.

All proofs will be available via Dropbox within 2 weeks of a standard shoot or 4 weeks of wedding. If an all-inclusive package is chosen, all final images will be available within this time.

Any digital downloads ordered will be available as soon as payment is made.

Any prints or printed products ordered will be delivered / posted to the Client(s) as soon as possible after payment is made. This is largely dependent on the Royal Mail.

MODEL RELEASE

Unless otherwise indicated, the Client(s) hereby gives permission to Sarah Minchin Photography to use their name(s) and photographic likeness in all forms of media for promotional purposes.
